Terms of Service
These terms are an agreement between you and Aiden Molyneaux, an individual developer in Ontario, Canada ("InGame", "we", "us"), for the InGame app and the website at ingamehq.com. By creating an account or using InGame you agree to these terms and to the Privacy Policy. If you do not agree, do not use InGame.
InGame is in early release. Features will change, some will be rough, and the service may go down without warning while we work on it.

1. Who can use InGame
You must be at least 13 years old. We do not collect your date of birth; creating an account is your confirmation that you are 13 or older. If you are under 18, you should have a parent or guardian's permission to make in-app purchases.
2. Your account
One account per person, and it is yours alone. Keep your password private and tell us if you think someone else has used your account. You are responsible for what happens under it.
Usernames are 3 to 20 characters of letters, numbers, and underscores, must be unique, and must pass our text screening. You can change yours from your profile, subject to a cooldown between changes. We may reclaim or rename a username that impersonates someone, violates section 5, or has been abandoned.
If you sign in with Apple and the email Apple verifies matches an existing InGame account, we link the Apple identity to that account rather than creating a second one. We will send you email for verification, password resets, and account notices. We do not send marketing email.
3. Content you contribute
Three kinds of things you make in InGame are visible to other people: catalog entries and edits (a game's name, studio, publisher, release date, and genres), card designs you publish, and profile text such as your username, bio, and gamertags. Recommendation notes you send to a friend are visible to that friend.
You keep ownership of what you create. You give us a worldwide, non-exclusive, royalty-free licence to store, display, render, and distribute it inside InGame for as long as the service runs, and to keep it after you leave in the anonymized form the Privacy Policy describes. We need this licence to show your card in the gallery and your catalog entry in search; we do not use your content for anything outside the service.
The catalog is shared. Entries and edits you contribute become part of it, credited to your username. Any user may edit them, any user may revert an edit, and we may correct, merge, or remove entries. You do not own a catalog entry, and facts about a game are not anyone's property.
Card art is made of shapes, letters, icons, and colours placed in the app. There are no image uploads and no AI art. You confirm that anything you type onto a card or into a catalog entry is yours to use and does not infringe anyone's rights. Game titles and related names belong to their publishers; InGame is not affiliated with or endorsed by any game company.
4. Published cards and adoption
A card you save as private stays private to your collection. When you publish a card, any user may adopt it. Adopting gives that user a permanent copy of the card's flattened image and full ownership, across their account, of any cosmetic components the card uses. They pay Pixels for the components they do not already own; the design itself is free. Your designer credit is part of the flattened image and travels with every copy.
Published cards cannot be edited. To change one, duplicate it into a new draft and publish that. You may unpublish a card at any time, which stops new adoptions and freezes its adoption count. Users who already adopted it keep their copies and their components. A never-adopted published card can be deleted; an adopted one can only be unpublished.
Adoptions earn you adoption counts, contributor standing, and achievements. They do not earn you Pixels or money.
You can share a card image outside the app. The shared image carries a "made in InGame" mark and the designer's credit.
5. Rules
Do not use InGame to:
- impersonate another person or organisation;
- harass, threaten, or target other users, including through usernames, bios, card titles, catalog entries, or recommendation notes;
- post hateful, sexually explicit, or otherwise unlawful text, or anything that sexualises minors;
- add fake, duplicate, or junk games, vandalise catalog entries, or make edits you know to be false;
- spam friend requests, recommendations, or reports, or file reports you know to be false;
- get around a block, a suspension, or a rate limit, including by making another account;
- exploit a bug in the Pixel economy, abuse store refunds to keep what you bought, or create accounts to farm the starting grant or Starter Pack;
- scrape the service, automate account creation, or reverse engineer the app or its API beyond what the law allows;
- use InGame if you are under 13.
6. Reports and moderation
You can report a card, a catalog entry, or a user from inside the app, and you can block any user. Blocking makes the two of you invisible to each other; the other person is not notified.
We may hide content, including automatically after repeated reports, revert catalog edits, remove junk entries, reset or rename a username, bio, or avatar, take down a card, and suspend an account for a set time or indefinitely. When we act on your account we tell you the reason and how to appeal. Appeals go through Settings > Help or the contact address in section 15.
If we take down a published card for a moderation or legal reason, copies held by users who adopted it may also be hidden; their collection falls back to another card for that game. A suspended account cannot sign in. Other users cannot tell a suspended, blocked, or deleted account apart; all three show as unavailable.
7. Pixels
Pixels (PX) are InGame's virtual currency. They exist only inside the app. Pixels have no cash value, cannot be redeemed for money, cannot be transferred to another user, and cannot be traded or sold outside InGame. You do not own Pixels; you have a limited, revocable licence to use them in the app under these terms.
You get Pixels from a starting grant, a daily claim on the Store screen, achievements, and by buying Pixel packs. Pixels are spent on premium cosmetic components and on adopting cards. We set and can change earn amounts, prices, and the components on offer at any time. A change does not undo a purchase you already completed.
Pixel packs are consumable in-app purchases sold through the Apple App Store or Google Play at the price shown at the time of purchase. The Starter Pack can be bought once per account. A pack is delivered to your balance when the store confirms the purchase. "Restore purchases" re-syncs your cosmetic entitlements and completes any interrupted transaction; it does not grant a Pixel pack a second time, because your balance is account state rather than receipt state.
Component purchases and adoptions are final. Components you acquire are entitlements on your account and stay there. If we discontinue a component, you keep what you have; it just cannot be acquired anymore.
We may credit or debit Pixels, or grant or remove an entitlement, to correct a bug, as goodwill, or to reverse abuse. Each such adjustment appears in your ledger, and each one is recorded with the staff member who made it and the reason.
8. Refunds
Apple and Google handle refunds for in-app purchases under their own policies. We do not process refunds ourselves. Request a refund from the store where you bought the pack.
When a store refunds a Pixel pack, we remove the full amount of Pixels that pack granted. This can take your balance below zero. A negative balance must be earned or bought back before you can spend again. Components and adoptions you already bought with those Pixels are not taken back, except where refunds are being used abusively, in which case we may remove them and take further action under section 6.
If a purchase problem is not resolved by the store, contact us and we will look into it.
9. InGame's own content
The app, its code, design, name, sounds, cosmetics library, and everything we made are ours or licensed to us. We give you a personal, non-transferable licence to install and use the app on devices you own, for your own non-commercial use, subject to these terms and the terms of the store you downloaded it from. On iOS, Apple's standard end-user licence terms also apply where relevant.
10. Availability and changes to the service
We may add, change, or remove features, and we may take the service down for maintenance. If we ever shut InGame down, we will give reasonable notice. Pixels and cosmetics have no value outside the app, and a shutdown does not create a right to a refund from us beyond what the app stores provide.
11. Ending your account
You can delete your account from Settings at any time. The Privacy Policy explains what is deleted and what is kept in anonymized form. Unspent Pixels are forfeited on deletion.
We can suspend or terminate your account if you break these terms, if the law requires it, or if we shut the service down. Sections 3, 4, 7, 8, 9, 12, and 13 continue to apply after your account ends.
12. Disclaimers and liability
InGame is provided as is. We do not promise that it will be error-free, uninterrupted, or that the catalog is accurate. The catalog is written by users.
To the extent the law allows, we are not liable for indirect, incidental, or consequential loss, or for lost data, lost Pixels, or lost cosmetics. Our total liability to you for anything arising from InGame is limited to the greater of the amount you paid for InGame purchases in the 12 months before the claim and 50 Canadian dollars.
Some of these limits may not apply to you. Consumer protection law in Ontario and other provinces, and the law of other countries, gives you rights that these terms cannot take away. Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are heard in the courts of Ontario, unless the consumer protection law where you live lets you bring a claim at home.
14. Changes to these terms
When we change these terms we post the new version here with a new date and a changelog entry below. For a material change, the app asks you to accept the new terms before you continue. For smaller changes, continuing to use InGame after the effective date means you accept them.
